Penyelesaian Kaedah Rundingan Damai Menurut Akta Perhubungan Perusahaan 1967

Abstract


Conciliation is an alternative settlement process for dismissal without just cause or excuse. The focus of this article is to discuss the conciliation process conducted by the Director General Industrial Relations of Malaysia (KPPPM) after receiving a representation complaint under Section 20 of Act 177. The methodology used is a qualitative approach, i.e., a legal study. (purely legal). The three primary sources used for this study are the statutes, decided cases, and settlement results statistics at the KPPPM level. The study's objective is to study settlement through the conciliation mechanisms used by the KPPPM as interpreted under section 20 of the Industrial Relations Act 1967. The purpose of analyzing the settlement decision through peace talks is to look at the trends in the outcome of settlements implemented by the KPPPM and the factors that represent variables to the finding of such a settlement. Such an outcome is essential to see whether the resulting decision through such conciliation is successful and consistent with the provisions of the Act or otherwise.

ABSTRAK

Rundingan Damai merupakan proses penyelesaian alternatif dalam hal berkaitan pemecatan kerja tanpa sebab atau alasan yang munasabah. Fokus yang diberikan dalam artikel ini adalah untuk membincangkan proses rundingan damai yang dijalankan oleh pihak Ketua Pengarah Perhubungan Perusahaan Malaysia (KPPPM) setelah menerima aduan representasi di bawah Seksyen 20 Akta 177. Metodologi kajian yang digunakan adalah pendekatan secara kualitatif, iaitu secara kajian perundangan (pure legal). Tiga sumber utama yang digunakan bagi tujuan kajian ini adalah statut, kes-kes yang telah diputuskan dan statistik hasil penyelesaian di peringkat KPPPM. Objektif kajian ini adalah untuk mengkaji penyelesaian melalui mekanisme rundingan damai yang digunakan oleh KPPPM seperti yang ditafsirkan menurut seksyen 20 Akta Perhubungan Perusahaan 1967. Dapatan analisa terhadap keputusan penyelesaian melalui rundingan damai adalah dengan melihat kepada trend hasil penyelesaian yang dilaksanakan di pihak KPPPM dan faktor-faktor yang memberi gambaran sebagai pemboleh ubah kepada penemuan penyelesaian tersebut. Dapatan tersebut penting untuk melihat samada keputusan yang terhasil melalui rundingan damai tersebut berjaya serta selaras dengan peruntukan akta atau sebaliknya.
