THE RIGHT OF LEGITIMATE DEFENSE IN CONTEMPORARY INTERNATIONAL LAW

Abstract


ABSTRAK

Kertas ini menjelaskan tentang hak untuk pembelaan yang sah menurut hukum antarabangsa yang biasa berlaku sebelum munculnya pelbagai peraturan antarabangsa. Kepentingan penyelidikan terletak pada hakikat bahawa ia adalah salah satu topik yang penting baik kepada peringkat antarabangsa mahupun peringkat kebangsaan. Banyak negara membenarkan bahawa pekerjaan mereka itu dan serangan ke atas negara-negara lain berasaskan daripada hak pembelaan yang sah. Perkara ini menjadi tanggungjawab kita untuk menjelaskan makna daripada hak untuk pembelaan yang sah dan sekatan kalau-kalau negara mentafsirkan hak untuk pembelaan yang sah berkhidmat untuk mencapai matlamatnya. Penyelidikan ini juga mengesahkan hak negara- negara  yang  lemah  untuk  mempertahankan  diri  dalam  kes  mereka  diserang oleh negara-negara kuat. Perkara ini merupakan matlamat kedua daripada penyelidikan ini. Sebagai kesimpulan, penyelidikan berakhir dengan keputusan berikut: Majlis Keselamatan dikawal oleh beberapa negara dan akibatnya, ia tidak boleh berurusan dengan kecederaan sebagaimana mestinya. Negara-negara ini menggantikan Majlis Keselamatan dalam memenuhi tugas-tugas supaya fakta-fakta yang wujud sepadan dengan kepentingan mereka. Manakala mereka menyerang negara-negara lain, mereka mentafsirkannya sebagai mengamalkan hak  mereka  yang  sah  dalam  mempertahankan  diri,  tetapi  apabila  negara- negara yang diserang menentang serangan ini, negara-negara yang menyerang mentafsirkannya sebagai tindakan pengganas.

ABSTRACT

This paper addressed the right to legitimate defense in the   international law before the appearance of any international regulation. The significance of the research lies in the fact that it is one of the important topics on the international and national levels. Many countries justify their occupations and invasion of other countries by the right to legitimate defense. This becomes incumbent upon us to clarify the meaning of the right to legitimate defense and its restrictions lest a country interprets the right to legitimate defense as to serve its goals. This research also confirms the right of the weak countries to defend themselves in case they are invaded by the powerful countries. This is the research’s second objective. To conclude, the research is culminated with following results: the Security Council is controlled by some countries and consequently, it cannot deal with casualties properly. These countries replaced the Security Council in fulfilling its tasks so they shaped facts to match their interests. When they attack other countries, they interpret it as practicing their right to legitimate self-defense, but when the attacked countries resist this attack, the attacking countries interpret it as a terrorist act.
