RULES OF JUDICIAL INTERPRETATION OF LEGAL TEXT IN THAI ADMINISTRATION COURT [قواعد التفسير القضائي للنصوص القانونية في المحكمة الإدارية التايلاندية]

Abstract

The study aims to shed ligh on the rules of the Thai Administrative Court’s interpretation of legal texts, as well as to provide examples of judgements rendered by it, by extrapolating the theoretical framework of interpretation of legal texts and the rules of interpretation of legal texts by the judge, as well as the Thai Administrative Court and its judicial rulings, The study strated by describing the establishment, development, jurisdiction and formation of the Administrative Court in Thailand, the meaning, types and schools of interpretation, followed by the rules of interpertation of legal texts by the judge, and ended by presenting models of judicial interpretation of legal texts issued by the Thai Administrative Court. The Study concluded that the process of applying legal texts and interpreting them is inseparable. Before the rule of law is imposed on a fact, it is necessary to know the content of this provision, which is only done through a process of interpretation, and by relying on sound and precise ways in which it can deal with the text in a way that achieve the objectives of the legislator. This makes the texts clear of its meaning, applicable to an environment without falling into contradiction and achieving justice. Thailand has adopted a system of double judiciary. The Thai Administrative Court is distinguished in interpretating legal texts, where the judge is bound by general rules when interpreting the law, as well as his constant commitment to the principle of balance and compatibility between the requirements of the public interest and the requirements of the private interest, by taking into account the principle of equality and the principle of respect for human dignity and the principle of protection of rights and freedoms of Individuals and principle of proportionality and other general principles of legal recognized by the Thai constitution to achieve justice.

تهدف هذه الدراسة إلى تسليط الضوء على قواعد التي يعتمد عليها المحكمة الإدارية التايلاندية في تفسير النصوص القانونية بالإضافة إلى عرض نماذج للأحكام الصادرة منها، وذلك من خلال استقراء الإطار النظري لتفسير النصوص القانونية وقواعد تفسير القاضي للنصوص القانونية، فضلا عن المحكمة الإدارية التايلاندية ونماذج الأحكام القضائية الصادرة منها، واستهلت الدراسة بسرد نشأة المحكمة الإدارية وتطورها واختصاصها وتشكيلها في تايلاند ثم ماهية التفسير وأنواعه ومدارسه تليه قواعد تفسير القاضي للنصوص القانونية وانتهاء بعرض نماذج من التفسير القضائي للنصوص القانونية الصادرة من المحكمة الإدارية التايلاندية. وتوصلت الدراسة إلى أن عملية تطبيق النصوص القانونية وتفسيرها لا يمكن فصلها، إذ إنه قبل إنزال حكم القانون على واقعة ما لا بد من معرفة مضمون هذا الحكم، وهو ما لا يتم إلا من خلال عملية التفسير، وبالاعتماد على طرق سليمة ودقيقة يستطيع من خلالها التعامل مع النص بما يحقق أهداف المشرع، فيجعل النص مفصحا عن معانيه، قابلا للتطبيق على بيئة دون السقوط في التناقضات وتحقيق العدالة. وقد تبنت تايلاند نظام ازدواجية القضاء، وتتميز المحكمة الإدارية التايلاندية في تفسير النصوص القانونية حيث يلتزم القاضي بقواعد عامة عند تفسيره القانون فضلا عن التزامه الدائم بمبدأ التوازن والتوافق بين متطلبات المصلحة العامة وبين متطلبات المصلحة الخاصة، وذلك بمراعاة مبدأ المساواة ومبدأ احترام كرامة الإنسان ومبدأ حماية حقوق وحريات الأفراد ومبدأ التناسب وغيرها من المبادئ العامة للقانون التي تقرها الدستور التايلاندي لتحقييق العدالة.
