NAVIGATING THE DICHOTOMY BETWEEN BIG DATA AND HEALTH DATA PRIVACY IN THE PURSUIT OF SDG

Abstract


The dichotomy between big data technology and privacy of health data exists when the application of big data is needed for innovations and the economy to achieve the SDGs. The dichotomy has sparked a legal concern, particularly in the areas of health data privacy and big data application. The usage of big data in the health sector draws upon a legal concern for health data privacy. In Malaysia, the application of health data warehouse using big data has invigorated concerns as to the status of data privacy, specifically from the community and non-governmental organisations. The reliability of health data for the application of big data is important for the development of health and social sector to achieve the global agenda of Sustainable Development Goals (SDGs) by 2030. This article aims to analyse the dichotomy between the rights to privacy of health data within the application of big data. The methodology applied in this study is the doctrinal legal analysis based on a human rights perspective. This article concludes that key values of data protection law should be a practical legal sample for other nations in harmonising health data privacy with the applications of big data technology to resolve the dichotomy and achieve the SDGs.
