Perbezaan antara Laluan Transit dan Laluan Ikhlas di bawah Konvensyen Undang-Undang Laut Antarabangsa 1982 (KUULA 1982) (The Differences between Transit Passage and Innocent Passage under the 1982 United Nations Convention on the Law of the Sea) (UNCLOS 1982)

Sejak abad ke 7 Masihi lagi, Selat Melaka sehingga kini merupakan salah satu laluan kapal utama dan yang paling sibuk di dunia. Selat ini merupakan laluan utama yang menghubungkan Lautan Pasifik dan Lautan Hindi bagi kapal-kapal perdagangan daripada seluruh dunia terutamanya Jepun, China, Korea Selatan dan lain-lain. Oleh itu, laluan transit di Selat Melaka perlu mempunyai laluan pelayaran yang baik dan selamat bagi memastikan laluan transit di Selat Melaka terkawal. Kajian ini mengguna pakai pendekatan kualitatif. Kajian in dilakukan untuk mengkaji perkembangan laluan transit Selat Melaka dan juga laluan ikhlas yang diaplikasi oleh negara pengguna di kawasan perairan wilayah Malaysia. Menurut KUULA 1982, takat permulaan perairan wilayah ialah selebar 12 batu nautika dari takat air surut (Fasal 3). Perbezaan antara kedua laluan turut dikaji. Seterusnya, cadangan penambahbaikan dinyatakan bagi peruntukan di laluan transit di Selat Melaka dan laluan perairan wilayah. Hasil kajian mendapati bahawa terdapat beberapa kelompangan berkenaan peruntukkan laluan keduanya dan undang-undang domestik di Malaysia tidak mempunyai peruntukkan spesifik dan menyeluruh berkenaan laluan transit dan laluan ikhlas. Oleh itu, perlunya ada satu peruntukkan yang jelas berkenaan laluan transit di Selat Melaka dan juga peruntukkan laluan ikhlas di terapkan dalam undang-undang domestik di Malaysia.

ABSTRACT
Since the 7th century AD, the Strait of Malacca has been one of the main and busiest shipping lanes in the world. This strait serves as a key passage connecting the Pacific Ocean and the Indian Ocean for trade ships from around the globe, particularly from Japan, China, South Korea, and others. Therefore, the transit passage in the Strait of Malacca need to be well-organized and safe to ensure controlled transit navigation. This study adopts a qualitative approach and aims to examine the development of transit passage in the Strait of Malacca and the innocent passage applied by user states within Malaysia's territorial waters. According to KUULA 1982, the baseline for territorial waters is set at 12 nautical miles from the low-water line (Article 3). The differences between these two passages are also analyzed. Subsequently, recommendations for improvements are proposed for transit passage and innocent passage. The findings of the study reveal several shortcomings concerning the provisions for both passages, and Malaysia's domestic laws lack specific and comprehensive for transit passage. Therefore, there is a need for clear provisions on transit passage in the Strait of Malacca and for the inclusion of innocent passage in Malaysia's domestic laws.
