SOLUSI ‘SHARENTING’ KEPADA KANAK-KANAK: ANALISIS PERBANDINGAN REMEDI UNDANG-UNDANG DI UNITED KINGDOM DAN MALAYSIA

Abstract


‘Sharenting’, iaitu amalan ibu bapa berkongsi imej dan maklumat peribadi anak-anak mereka dalam talian, menimbulkan implikasi serius terhadap hak privasi, kesejahteraan psikologi, autonomi, dan perlindungan kanak-kanak. Meskipun risiko-risiko ini telah diketahui umum, ramai ibu bapa masih berkongsi imej dan maklumat tersebut secara berlebihan. Kanak-kanak yang terkesan mungkin berasa terancam dari segi privasi dan membantah pendedahan maklumat peribadi mereka, seterusnya mengemukakan permintaan kepada ibu bapa agar memadam kandungan tersebut. Secara prinsipnya, ibu bapa sepatutnya menghormati permintaan ini, namun keengganan mereka dalam sesetengah keadaan menimbulkan keperluan untuk mekanisme remedi undang-undang yang membolehkan kanak-kanak mendapatkan pemadaman kandungan yang menjejaskan kepentingan mereka. Artikel ini menganalisis permohonan injunksi berdasarkan pelanggaran kewajipan kerahsiaan, penyalahgunaan maklumat peribadi, dan pencerobohan privasi dalam konteks sharenting di United Kingdom dan Malaysia. Selain itu, ia turut mengkaji keberkesanan hak untuk dipadamkan dan hak untuk membantah di bawah rangka kerja perlindungan data dalam melindungi kepentingan kanak-kanak. Dapatan kajian menunjukkan bahawa penguatkuasaan hak untuk dipadamkan menawarkan remedi yang lebih berkesan bagi kanak-kanak yang terkesan akibat sharenting. Namun, ketidakjelasan dalam tafsiran perundangan serta ketiadaan garis panduan khusus dalam konteks mekanisme pemadaman atau penghapusan data untuk kanak-kanak yang terlibat dalam sharenting menekankan keperluan untuk kajian lanjut. Oleh itu, artikel ini menekankan kepentingan garis panduan yang lebih jelas bagi memastikan keseimbangan antara hak privasi kanak-kanak dan hak ibu bapa untuk berkongsi kandungan dalam talian.
